1. Agreement to Terms

By accessing or using our Service (aiimagecare.com and its associated tools), you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

2. Use of Service

AI Image Care provides a suite of AI-powered health image analysis tools for informational purposes only.

THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE. The information, including but not limited to, text, graphics, images, and other material contained on this website and provided by our AI tools are for informational and educational purposes only. No material on this site is intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health care provider with any questions you may have regarding a medical condition or treatment and before undertaking a new health care regimen. Never disregard professional medical advice or delay in seeking it because of something you have read on this website or an output from our AI tools.

2.2. Permitted Use

You are granted a non-exclusive, non-transferable, revocable license to access and use the Service strictly in accordance with these Terms. As a condition of your use of the Service, you warrant to AI Image Care that you will not use the Service for any purpose that is unlawful or prohibited by these Terms.

You may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Service.
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service.
  • Obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Service.
  • Upload or transmit any material that is illegal, defamatory, obscene, or infringing on intellectual property rights.
  • Attempt to decompile, reverse engineer, or otherwise discover the source code of our AI models or software.

2.3. User Responsibility for Uploaded Images

You are solely responsible for the images you upload to the Service. You represent and warrant that you have all necessary rights and permissions to upload such images and that your uploads do not violate any applicable laws or infringe upon the rights of any third party (including privacy and intellectual property rights).

You agree not to upload images that:

  • Are illegal, explicit, or offensive.
  • Contain personally identifiable information of others without their explicit consent.
  • Infringe on copyright, trademark, or other intellectual property rights.

AI Image Care reserves the right, but not the obligation, to review and remove any images that violate these terms or are otherwise deemed inappropriate, at our sole discretion.

3. Intellectual Property

The Service and its original content (excluding content provided by users, such as uploaded images), features, and functionality are and will remain the exclusive property of AI Image Care and its licensors. The Service is protected by copyright, trademark, and other laws of both [Your Country/Jurisdiction] and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AI Image Care.

4. Accounts

If any part of our Service requires you to create an account, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

AI IMAGE CARE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK.

NEITHER AI IMAGE CARE NOR ANY PERSON ASSOCIATED WITH AI IMAGE CARE MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. WITHOUT LIMITING THE FOREGOING, NEITHER AI IMAGE CARE NOR ANYONE ASSOCIATED WITH AI IMAGE CARE REPRESENTS OR WARRANTS THAT THE SERVICES, THEIR CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SERVICES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

AI IMAGE CARE HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

IN NO EVENT WILL AI IMAGE CARE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

7. Indemnification

You agree to defend, indemnify, and hold harmless AI Image Care and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms, or c) content you post to the Service (including uploaded images).

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country/State/Jurisdiction, e.g., State of California, United States], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
